* ?Went off to the pharmacy after lunch, and back home quickly. ?Wrote?Creating a Source List Report in RootsMagic 5?and set it for later.

* ?Started on my source list for Westminster, Mass. using the Westminster VR book. ?Got about half done by dinner time. ?Watched football and read the paper, then walked over to neighbor's house to take her something. ?Home to water the lawn.

20.?OX restaurant is a temple to ?the wood-fired grilling tradition of Argentina, and with it, the culinary heritage of Spain, France and Italy?. Opened in early 2012 by?Qui??nez and Greg Denton, Ox has shot to the top of? Portland?s ?must visit? restaurants, and placed number one on my 2012 Best New Restaurant List.

On a recent warm summer evening, I ordered two empanadas.?The crusts were light, beautifully folded and crimped. One cradled juicy cumin-spiced beef, piquant green olives, and sweet raisins; a classic combination of flavors. The second held sweet grilled corn, which melded with poblano, potato and fontina. They were marvelous and light; far better than I had learned to make myself when I was dating an Argentinian many years ago.

A salad of grilled raddicchio, arugula, avocado, chevre, grilled corn, toasted garlic, and an anchovy vinaigrette was my least favorite item on the menu.? I felt there were too many flavors competing for attention ? nothing drew my attention. The ch?vre was fresh, light and mild flavored, giving creamy bits of texture, but the corn wasn?t as sweet as it was in the empanada, and tasted like it had been grilled ahead of time and had dried a bit.

A better option are the bruschettas, one with wood-fired house ricotta, foresty saut?ed morels, balsamic brown butter and smoky grilled bread; a second version showing the Asian influences on Argentinian cuisine, with sweet Dungeness crab, creamy avocado, paper-thin slices of radish, cucumber and a minty shiso. Both are excellent, the crusty bread?yielding?quietly to the teeth.

The large lamb chop will arrive with a sprig of rosemary still smoking from the heat. It is delicious and mild, with perfect brown bits of char and grill flavor, but not so much that it overwhelms the mildness of the lamb. The meat is moist, tender, and properly cooked with a nice pink color throughout.

I have a pork chop fetish. If it?s on a menu, I?ll order it, but most restaurants can?t seem to get it right. Not so at Ox, where I was presented with almost two juicy inches of sweet and savory meat on the bone. The maple-brine fairly glistened as it was put before me; my hands trembled when it gave willingly beneath my knife. It was the best damn pork chop I?ve had in ages.

One evening the server talked me into trying the goat special. I like goat now and then, but there are so many good things on the menu, she had to work to get me to order it. It was easily the best I?ve had in Portland; a huge mound of sweet, moist and slightly?gamy?meat. It was more than I could possibly eat, and made a great lunch the next day.?I wanted to hug her.

If you are the type of person who likes to sample lots of different dishes, throw caution to the wind and order the ?Asado Aregentino for 2?, a robust monument to meat: fatty grilled short ribs, deliciously charred and unbelievably tender skirt steak, a large?house chorizo ? which seems to remind everyone of pepperoni, morcilla (blood) sausage, and on the very top, little mellow sweetbreads. All of this is?piled high on one relatively small plate; it?s an impressive feat. On the side is a large bowl of serviceable fried potatoes with mild horseradish aioli, a?sprinkling of dill, and the final dish, a green salad. As with everything else on the menu, you?ll also get a ramekin of the ubiquitous Argentinian chimichurri, which I think could use a bit more oomph. Your table will be covered with food. Lean over the platter and breathe deep; you?ll be assaulted by the hot scents of asado. Morcilla is the Spanish/Argentinian version of dark, rich blood sausage. If you haven?t experienced it before, don?t think about it, just give it a try. The Ox version is very good, full of walnuts that give it texture, and a blend of spices that are a bit different than European versions.

The rib-eye is the king of steaks in Argentina ? you see it everywhere. In that country, when it is brought to your table, it is often followed by a parade of accompanying ramekins: hard-boiled quail eggs, chickpea mash, garlicky potatoes, several kinds of mashed potatoes, sweet confit of garlic cloves? you can easily end up with a dozen. These accompaniments are used in little dabs to cut fat, soften some flavors, sweeten others. The entire list of our five taste senses are represented in these sides. Don?t get me wrong, a rib-eye as cooked by Ox is?terrific; it checks off all of my boxes, but I?m hoping they start experimenting with more sides once things settle down. I know a few restaurants in Buenos Aires that we could jet down to? I?ll just be quiet.

If you are in the mood for fish, try the wild Alaskan halibut on the bone. It?s a large portion with smoky, crispy skin, and a moist, creamy flesh; lightly grilled and sprinkled with flowers. Another of the seafood options, Oregon white prawns, arrive in a large dish almost overflowing with the crustacean. The flavors are simple, letting the shrimp speak for themselves, a melange of onions and flower petals turning them into art.

The dessert list always seems to have an item which reminds me of my past. Nothing says ?grandmother? more to me than a buckle, or a grunt, but pass them up. Don?t get me wrong, they are well made, and the fruit is sweet and good; it?s just that there are better options.

A case in point, the torte, which will prove my theory that we all have a dinner tank, and a dessert tank. It is warm and moist, tasting of hazelnuts and butter. Next is a scoop of ridiculously good chamomile-honey ice cream. To finish, a piece of sticky, light ?honeycomb candy? is perched atop. It?s an anthem to fall.

There are, of course, other choices: a better than average maple and sweet-corn panna cotta, and ?Magic? ? roasted peach-blackberry sorbet, enrobed in a bittersweet chocolate shell with sweet summer fruits. The bittersweet chocolate cake could use a bit of restraint. the tall glass contains cake, tres leches, dulce de leche mousse, and some brul?ed banana. I thought it was a bit much.

Service is excellent. In all of my visits there was never a gaffe. A complete bar is available, along with a good, fairlypriced wine list. I?m surprised it doesn?t contain many Malbecs, rather it represents many regions, most of them fairly big wines, which is just fine to me. When I asked about a couple by the glass choices, the server brought a sample of each ? big points. The cocktails are a mixed bag; I?ve found their house specials were good, but off menu classics could use a little work.

There is a reason this restaurant is on the radar. We?ve?had others in this genre, but none pulling it off as well as OX. This is a restaurant that will remain at the top of every list for some time.

Now if they just add?fejoada to their winter menu.

The self help gurus and MLM leaders aren?t going to like it but the truth is the truth.

Leadership, as currently touted in MLM, is not only dramatically over-rated??it?s harmful.

Imagine a new person just signed up with you and they plug into all these rousing leadership speeches.

It creates fear.

Why?

80% or more is linked to nonsense that does not apply to networking and the other 20% is linked to the leaders? volume, pin level and years in the business.

And Sally, your new sign up, is overwhelmed.

But what will they follow if they don?t follow the BIG HITTER?

Simple

?

All you have to do is lead them to the next step both effectively and efficiently.

HOW TO DOUBLE AN MLM PAY CHECK

There?s an old saying in MLM?..as soon as we reclaim our common sense, our paycheck doubles.

I?m not sure it?s true?.my experience is that it more than doubles.

What behavior does Sally, your new rep, need to engage in with you to build her confidence?

It?s a multiple choice?..easy one for you and a great reminder for me.

  1. Learn John Maxwell?s Leadership Principles?
  2. Listen to the top earners who?ve been doing this for 10 or 20 years and love talking about themselves and leadership?
  3. Learn everything about the plan, product and company like ?leaders? do?
  4. Talk to people and earn some money?

If we are going to make some money, we need to talk to people.?? That?s a common sense and it?s pay raise. BOOM!

All you have to do is make calls with them, teach them the network marketing skills that get a ?yes???and repeat until they master it.

Very simple 3-step tip here??and it?s huge?.

Influence is everything. Focus on behaviors, not results.

STEP 1 ? find out what Sally desires and help her engage in the 1 behavior that will create checks.?? The problem with the blow-hearts talking about leadership is that they always talk about results.? This is a massive mistake.? And I can prove it, [previous post].

Sally is looking to you??not the plan, product, company or leaders [wink-wink] she hears on conference calls [for goodness sake, limit her to a max of 1 month that you choose.....not her] ?.she?s looking to you.?? She won?t tell you but bank it as a truth that will make you wealthy.? So lead?..by teaching here the skills hands on.??? The cool thing??? It?s the only leading you ever have to do.?? Lead by example, demonstrating the only income producing, goal advancing behavior in the MLM biz.

And when she does, if you?ll focus on her desires and link them to the behavior she must engage in to obtain her objective, you?ll become a top 5% producer in MLM.

Sally is now ?influenced? by you and ready to make calls with you.

STEP 2 ? be prepared.? Getting a ?yes? 80+% of the time is a skill.?? Everybody knows we simply cannot teach what we do not know.? You?ve got to learn and demonstrate the skills.

STEP 3 ? repeat.? Go through the same process with Sally?s new people and Sally listening.? Soon you become a group of people helping people learn the skills hands on.? And?.new people joining will, as I said in the video, ?copy? the behavior of the group to gain acceptance.? This is a pretty simple skill that insures duplication.

Big Money? Work 3-Deep, hands on.

Without question, by focusing on Sally?s desire and linking that to behaviors, not results, will gain influence?..all you have to do is execute.

Did your upteam make calls with you?

Teach you the skills?

Work with your personals?

And their personals?

?..would it have made a difference?

No matter.

What matters is that you do it because it?s you that is going to be the difference, in the end?.in Sally?s success.

Mom furious male vice principal spanked her daughter

A Texas mother is furious that male vice principal left her daughter bruised and blistered after a spanking, which the girl opted for over another day of in-school suspension for cheating in class.

Taylor Santos, a sophomore at Springtown High School, northwest of Fort Worth, Texas, told school officials?that she didn?t know another student had copied her classwork, but school officials gave both girls two days of in-school suspension as punishment.

After serving one day, Taylor said she didn?t want to miss any more classes, so she went to the vice principal?s office and opted instead for a paddling ? a legal form of punishment in schools in Texas and 19 other states,?according to the?Center for Effective Discipline.?

Because school policy says spanking or paddling requires that parents give permission, the vice principal had Taylor call her mother, Anna Jorgensen, who gave her approval.

"I knew school policy was females swatted females and males swatted males,? Jorgensen told WFAA-TV in Dallas-Fort Worth.??If Taylor wanted that, I said that would be fine.?

But what happened instead was the vice principal himself swatted Taylor while a woman was present in the room, despite school policy that states ?corporal punishment shall be administered only by an employee who is the same sex as the student."?

After learning who did the spanking and seeing the wounds on her daughter's body, Jorgensen said she was horrified.

"I came unglued," Jorgensen said. ?It looked almost like it had been burned and blistered, it was so bad,? she said of her daughter?s bottom, adding that she took photos of injuries to prove how red they were.

Jorgensen called the vice principal to complain, but he told her it was perfectly normal for her daughter?s bottom to look like that. He reportedly added that he wasn?t aware of the school?s same-sex swatting policy.

Springtown Superintendent Mike Kelley told WFAA that school officials never administer corporal punishment unless a parent requests it. While he declined to speak on Taylor?s case specifically, he stressed that two adults are always present when corporal punishment is administered, but he said the school district may have made an error.

Kelly also said he wants to do away with the current policy because the male-to-female ratio of administrators at the school makes it a difficult policy to adhere to. He said he will ask the school board to get rid of the same gender requirement at a board meeting Monday.?

For her part, Jorgensen said she will be in attendance at that meeting to urge the school board to keep the gender-based policy.

"I think Taylor is proof that we need to keep that policy," Jorgensen said. "I don't believe a man intentionally meant to do that to her, but it still happens, because men are too big and strong to be hitting 96-pound girls."

More than 220,000 school children nationwide were subjected to physical punishment during the 2005-2006 school year, according to the Center for Effective Discipline, citing the most recent figures available.

At one school in Florida,?the woodshop class at?Holmes County High School?actually makes the paddles used to spank any of the more than 500 students.?

In another Florida town, east of Tallahassee, townfolkd make paddles out of plexiglass for?Madison?County Central's elementary and middle school, the dean of schools said.

New breast cancer clues found in gene analysis

NEW YORK ? Scientists have completed a major analysis of the genetics of breast cancer and find four major classes of the disease. They hope their work will lead to more effective treatments.

The new findings offer hints that one type of breast cancer might be vulnerable to drugs that already work against ovarian cancer.

The study appeared online Sunday in the journal Nature. It?s the latest example of research into the biological details of tumors, rather than focusing on where cancer arises in the body.

The hope is that such research can reveal cancer?s genetic weaknesses that someday can be targeted by drugs, even some already in use.

Obama aims for Wisconsin, Romney seeks California cash

WASHINGTON (AP) ? A breeze of momentum on his side, President Barack Obama was trying to shore up support in a pivotal state Saturday while he and rival Mitt Romney argue over who can change the country's political culture and best protect the financial and health security of older Americans.

Obama was traveling to Wisconsin, which his campaign had considered safely in his column, for his first visit since February. Obama aides seem eager to fortify that hold in case Romney's running mate, Wisconsin Rep. Paul Ryan, can erode some of the president's support as the candidates' first debate, on Oct. 3, fast approaches.

Facing some second-guessing within his own party over his strategy, Romney planned to raise money in California in hopes of recovering his fundraising advantage. Last month, for the first time, Obama and the Democratic Party raised more than Romney and the Republican Party, $114 million to $111.6 million.

Romney has opened a new line of attack against Obama, saying the president has failed to deliver on his promise of change. Ryan, campaigning Saturday in Miami, reinforced that message by poking at Obama's recent comment that it's hard to change Washington from the inside without mobilizing public pressure on Congress from the outside.

"Why do we send presidents to the White House in the first place?" Ryan asked. "We send presidents to change and fix the mess in Washington, and if this president has admitted that he can't change Washington, then you know what, we need to change presidents."

Obama is hitting back by portraying Romney as an insider beholden to partisan and corporate interests. Vice President Joe Biden seconded his boss during a Saturday appearance before an audience of Teamsters kicking off an effort to canvass for votes in Manchester, N.H.

Biden said it was because of unions that the U.S. has a strong middle class, and he accused Romney and Ryan of having "a completely different value set, a completely different vision."

"They're doubling down on everything that caused the economic crisis in the first place," he said.

Romney on Friday tried to put an end to an old sticking point by releasing his 2011 tax returns and his past tax rates. The disclosures reinforced his status as one of the wealthiest candidates ever to seek the presidency. Obama tried to gain an edge with older voters and near-retirement baby boomers by renewing his criticism of Romney's Medicare proposals.

Obama entered the weekend with polls showing him in a near tie with Romney nationally. But the latest Wall Street Journal/NBC News/Marist Poll shows the president with leads among likely voters of 8 percentage points in Iowa and 5 points each in Colorado and Wisconsin, some of the most competitive states. Polls published earlier this week pointed to leads for Obama in closely contested Virginia and Ohio.

In a potential opening for Romney, fresh state-by-state unemployment numbers show rises in August unemployment in five critical states.

Romney, responding to Obama's comments about how hard it is to change Washington from the inside, said Friday in Las Vegas: "Over history there have been people that have changed Washington from the inside," Romney said Friday in Las Vegas. "And they've done it effectively by showing leadership from the top."

Obama countered with a new line of his own: "What kind of inside job is he talking about?" He suggested that Romney would rubber-stamp the agenda of congressional Republicans or let oil companies run the country's energy policy.

"We don't want an inside job in Washington," Obama said. "We want change in Washington."

As some Republicans urged Romney to re-energize his campaign, the candidate headed to San Diego and Los Angeles to raise money Saturday. His schedule for Sunday put him in Colorado, a state where polls show Obama with a narrow lead. Starting Monday, Romney and Ryan will spend three days altogether in Ohio.

In Wisconsin, public polls still show Obama with a lead, and his campaign recently began airing ads. Vice President Joe Biden has visited the state twice this month. Ryan has held events back home three times, once with Romney along.

Obama won Wisconsin easily in 2008 but Ryan is popular. Some Republican pollsters detected a bump for Romney in the state shortly after Ryan was named his running mate. Wisconsin's 7.5 percent unemployment rate is below the national average, but the state's manufacturing industry has been hit hard in recent years.

Obama's campaign is focused on running up big margins in Milwaukee and Madison, both Democratic strongholds. Obama and Romney will be closely watching the Green Bay region, a swing area that could tip the balance in a close contest.

On Friday, Wisconsin's Republican governor, Scott Walker, said that immediately after Romney chose Ryan, the campaign displayed a new sense of enthusiasm, excitement and adrenalin.

"I haven't seen that as much lately," he said, "and I think they need to get back to that if they're going to win this election."

About President Obama's Statement in Support of Gay Marriage

I am deeply moved by the announcement made a short while ago that President Obama has gone back to his original position in 1996 and come out publicly in support of same-sex marriage. It may seem like a risky move, but the majority of Americans already support the equal rights of gays and lesbians to marry. Public opinion has completely flipped since 2004. It's been a faster change than anyone could have predicted. But the older generation with their anti-gay views are replaced with a younger generation who are not as rigid, hate-filled, frightened, and bigoted as many of their elders. Hate to have to put it that way, but that's the truth. It's why we were able to have an African American president, and it's why I believe, in spite of all other proof to the contrary, things WILL get better in this country.

One other point: One reason the majority's opinion on this issue has changed is due, in large part, to the many of our gay and lesbian brothers and sisters who have taken the risk and come out of the closet. By doing so to their friends, family, neighbors, classmates and co-workers, they have forced people to deal with them as human beings. It is much harder to hate when that gay person is your son, that lesbian is your aunt, that homosexual is the person who covers for you on the job when you've got a sick kid, and that gay couple next door have the best-kept yard on the block (I'm not saying they're better at gardening, I'm just saying, they're neighbors, like anyone else). So, the more people said they were gay, the faster that fear and hate peeled away.

To all of our gay and lesbian citizens who have had to suffer for far too long in this "land of the free," thank you (and President Obama) for making us a true home of the brave.

Addendum #1: Yes, Obama did the wrong thing not speaking out before the North Carolina vote to ban gay marriage yesterday. I don't know the guy, but let me suggest this: perhaps he was as disgusted by that vote as the rest of us were today and just couldn't remain silent any longer. For those of you who are commenting and saying that this was just a calculated political move on his part ? well, what politician, the day after the public votes one way, comes out the OTHER way. This is a swing state. A slick pol, on this day after, would have either remained silent or said something to show he is "with the people." He didn't do that. He took the position opposite to the one the majority of people in North Carolina took. Look, I have a lot of criticisms of Obama. I have been profoundly disappointed by him. But when he does the right thing, he needs to hear from the majority that we support what he did. You can't stay stuck in your cynicism every single day.

Addendum #2: I agree there are many older people who aren't bigots and who are more open-minded than their peers. But the polls are very clear on the age issue: According to ABC News tonight, 61% of those under 40 are in favor of legalizing gay marriage. But for those over 65, the majority are opposed and believe it should be illegal, with only 40% in favor of same-sex marriage. That is a HUGE generational gap ? and a testimony to the older boomers who raised these "kids" to grow up to be loving, accepting human beings.

It is a sad fact that people die an untimely death from all sorts of tragic occurrences. They can be killed in an auto accident, on the job/ job site accident, riding an amusement park ride or taking a prescription medication. There are all types of factors that can lead to someone?s death. Sometimes these factors are immediately known and obvious but other times, it takes investigation?possibly countless hours of digging and research?to expose all the causes of the tragedy.

Regardless of what type of tragedy occurred, the reality for the surviving family members is the same?they are left grieving, struggling to cope with their unexpected loss, and possibly in financial distress. So what can a grieving family do to make sure that justice is served if another party?s negligence or actions contributed to the death of their loved one?

They can pursue a wrongful death legal case. Oklahoma, like all states, has a wrongful death statute. (Oklahoma?s Wrongful Death Statute, 12 O.S. ?1053). Oklahoma?s Wrongful Death Act establishes who is entitled to file a wrongful death lawsuit. Surviving spouses and children would obtain a personal injury attorney to handle the case. They would be the Plaintiff in the case and according to the statute, they are entitled to recover certain damages if the defendant is found to be responsible/guilty.? These are considered punitive damages, and they are: Burial and funeral expenses; medical bills; pain, suffering, grief and loss of companionship.

The family designates a personal representative of the deceased party?s estate (typically the surviving spouse if there is one). As you can imagine, the pain and loss are difficult things to measure and attach monetary values to. It is important that surviving spouses and or children document their feelings and their loss and be prepared to explain the relationship that they had with the deceased. It is also important that all expenses pertaining to the death of their loved one are documented with receipts saved.

The economic, financial loss that surviving family members experience can be recoverable (at least in part) under what is known as ?pecuniary loss.? These are the loss of earnings and contributions to the household that have been experienced by the plaintiff(s).

An important thing to note is the timing for filing a wrongful death case. A statute of limitations is a law that limits the time period following certain events during which someone can file a legal claim. Once the time period established by the statute has been reached, the plaintiff can no longer pursue money damages. For wrongful death actions in Oklahoma, the lawsuit must be filed within two years of the date that the person passed away.

(AP) ? The leaders of the rebel Free Syrian Army said Saturday they have moved their command center from Turkey to Syria with the aim of uniting rebels and speeding up the fall of President Bashar Assad's regime.

Brig. Gen. Mustafa al-Sheikh, who heads the FSA's Military Council, told The Associated Press that the group made the move last week. He would not say where the new headquarters is located.

The FSA has been the most prominent of the rebel groups trying to remove Assad from power, although its authority over numerous locally-based networks of fighters is limited. And its commanders have come under criticism in the past for being based in neighboring Turkey while thousands are dying on the ground in Syria.

FSA commander Col. Riad al-Asaad issued a video titled "Free Syrian Army Communique Number 1 from Inside" that the command has moved to "liberated areas."

In the past few months, rebels have been able to capture wide swaths of territory along the Turkish border and three border crossing points on the frontier, which has allowed them to ferry both materiel and people to help in the fight to oust Assad. The rebels also have seized control of several neighborhoods in the northern Syrian city of Aleppo, the country's largest and commercial capital, in weeks of bloody fighting.

Despite the announcement that the FSA's command center has been shifted to Syria, the rebels will continue to rely on Turkey, which has been one of the bases for fighters and supplies flowing back and forth into Syria.

In the video, al-Asaad, wearing a military uniformed and surrounded by about a dozen gunmen, said the aim of moving its command operations into the rebel-held areas is to "start the plan to liberate Damascus soon, God willing."

The colonel said the FSA rejected offers from outside powers to make "suspicious deals" in which it replaces Assad's regime.

"Our aim is not to be a replacement for the falling regime that is taking its last breaths, but our aim is that what the Syrian people agree on will be the substitute," he said. "We are only part of the Syrian people."

Activists say that nearly 30,000 people have been killed since Syria's crisis began in March last year. The uprising began with largely peaceful protests against Assad's regime, but has since morphed into a civil war in the face of a brutal government crackdown.

"There are liberated areas now and it's better for the command to be with the rebels instead of being abroad," al-Sheikh said from Turkey. The general said he has been going back and forth to Syria.

Al-Sheikh said moving the command to Syria "will speed up the fall of the regime because it will give a big boost to the morale of rebels and there will be a command to follow-up on operations."

Also Saturday, the Turkish military deployed three howitzers and an anti-aircraft gun near the border with Syria, the private Turkish news agency Dogan reported. Earlier this week, the Tal Abyad crossing between Syria and Turkey in that area came under rebel control, but fighting in the region has continued to rage as Syrian regime forces attempt to retake the crossing.

Dogan news agency video showed at least three large military trucks towing the guns along a highway.

Oracle's 1Q earnings rise, but revenue disappoints

SAN FRANCISCO (AP) ? Oracle's earnings matched analyst estimates in the latest quarter, but a revenue decline signaled the business software maker is having a tougher time closing deals.

The fiscal first-quarter results announced Thursday are the latest indication that companies and government agencies are clamping down on technology spending amid mounting uncertainty about the economy.

Oracle Corp. earned $2.03 billion, or 41 cents, per share for the three-month stretch ending in August. That's an 11 percent increase from income of $1.84 billion, or 36 cents per share, at the same time last year.

Excluding certain accounting items, the Redwood City, Calif., company says it earned 53 cents per share, mirroring analyst projections.

Revenue dipped 2 percent from last year to $8.18 billion. That was more than $200 million below analyst forecasts.

Like many U.S. companies that depend on overseas customers for a lot of their sales, Oracle was hurt by weakening currencies in Europe and other parts of the world. The currency fluctuations translated into fewer dollars during the latest quarter compared to a year ago.

If exchange rates had remained unchanged, Oracle said its earnings per share would have been higher by 3 cents and its revenue would have edged up by 3 percent instead of dropping.

Concerns surrounding weakening economies in Europe and the unwieldy debts being shouldered by some European countries have pressured the euro, which is used by 17 European countries.

Those worries also are weighing on decision makers in corporate and government technology departments, making them more reluctant to invest in new products and features until they get a better handle on the economy's direction.

The manufacturers of personal computers, processors and other hardware have been hurt the most by this trend, but Oracle's performance may raise questions about whether business software makers are starting to feel the pinch, too.

Oracle continued to struggle in its recent foray into hardware, a move punctuated by the company's $7.3 billion acquisition of Sun Microsystems in 2010. Oracle's total hardware revenue plunged 19 percent from a year ago.

Database and applications software remains Oracle's financial backbone.

In a key indicator of the company's health, Oracle's sales of new software licenses and subscriptions rose 5 percent from the same time last year. This category is watched closely by investors because new licenses provide the foundation for future upgrades and maintenance, creating a steady stream of recurring revenue.

The pace of Oracle's software sales decelerated from the previous quarter, During the three months ending in May, Oracle's new software licenses increased by 7 percent from last year.

Oracle shares added 2 cents in extended trading to $32.28 after the numbers came out. In regular trading, they had closed down 52 cents to $32.26.

Fazli Ajdari, Rexhep Aliu, Shaqir Shaqiri, Idriz? Aliu, Ramadan Halimi, who are on the run have been cleared of all charges and the international warrant for their arrest has been revoked. Shemsi Nuhui, who was extradited to Serbia in May 2012, was also released.

The presiding judge, Snezana Nikolic Garotic, said on Wednesday that the sentenced men were found guilty of abuse, rape and torture of protected witnesses C1 and C2.

The two women, both Kosovo Serbs, were kidnapped on June 17, 1999, taken to a dormitory in Gnjilane and raped, humiliated and tortured on a daily basis until they managed to flee to Serbia on June 23.

?Medical documentation matched the testimonies of protected witnesses and, although there were some discrepancies with their preliminary testimony in Nis in 1999 regarding the time of the crime, the court accepted their testimonies as authentic,? explained Judge Nikolic Garotic.

The judge added that the Trial Chamber unanimously concluded that the defendants violated the Geneva Convention.

The court rejected the prosecution?s claims that the Kosovo conflict lasted till December 1999, when the Kosovo Liberation Army, KLA, was disarmed, since Serb forces withdrew from the territory on June 20.

The court also dismissed the testimony from the prosecution?s key witness, code-named Bozur 50, on whose testimony the indictment was based.

?The witness talked about widely known facts which were of no significance for the trial. The court checked his claims that bodies of the victims were incinerated and butchered and after forensic examination established that the bodies intact."

"Also, we investigated claims that bodies were put into bags and thrown into the Livac Lake. However, after the lake has been searched, no remains were found,? said the judge.

The judge added that 206 witnesses were examined in the course of the trial, 179 of victims and ?families of victims.

?All 179 of these witnesses described the events in Gnjilane, but not those specified in the indictment, but other crimes for which they specifically blamed their Albanian neighbours. None of the witnesses described the events specified in the indictment. Also, none of them named the defendants as perpetrators,? explained the judge.

The judge emphasised that in this case the prosecution was dealing with a staged event and misused the suffering of victims, and dismissed the prosecution?s claims that the defendants threatened the prosecution during the trial.

A court in Belgrade sentenced nine members of the Gnjilane Group to a total of 101 years in prison for war crimes against civilians on January 21, 2011.

The War Crime Chamber of the Appellate Court in Belgrade quashed that verdict on December 7, 2011, and set the case for a retrial.

The War Crimes Prosecution?s Office is satisfied with the sentencing part of the verdict, but it said it would appeal the acquittal of six defendants.

The defence also announced they would appeal to the Appellate Court.

Attorney General Madigan Files Lawsuits in Sweep of Fraudulent ...

Chicago --(ENEWSPF)--September 20, 2012. ?Attorney General Lisa Madigan today announced she has filed five lawsuits in a sweep of fraudulent home repair businesses that cheated homeowners in Chicago and Central Illinois out of more than $365,000.

Madigan said the companies operated home repair scams, soliciting homeowners for repair work and requiring large, upfront payments to begin the work. But the lawsuits allege the contractors failed to do much work ? if any at all ? beyond cashing homeowners? deposits. Madigan said in some cases, these con artists operated as ?storm chasers,? swooping into communities after severe storms to take advantage of people scrambling to repair damage to their homes.

?In all of these cases, there were red-flag warnings that the contractors were up to no good,? Madigan said. ?Any time a repair company solicits door to door or uses high-pressure tactics to sign up customers, it?s a signal that something is wrong. I urge homeowners to use extreme caution when hiring contractors. Do your homework and ask plenty of questions before signing anything.?

Madigan filed lawsuits against the following defendants:

  • National Restoration of Illinois and President John Curtis, a Lake in the Hills-based company for allegedly operating as an unlicensed insurance adjuster, negotiating weather-related damages with a homeowner?s insurance company. Homeowners were defrauded of their insurance checks intended for repair work that the company never completed.
  • Gulli Construction and owner Dominic Gulli, based in Chicago, for allegedly soliciting homeowners door to door for roofing and other repair work though the defendant is not licensed. Madigan said Gulli disappeared for weeks after contracting work with homeowners.
  • North Point Exteriors Inc. and owner Lateef Farooqui, based in Barrington, for allegedly offering unlicensed insurance adjusting services after storms in Chicago area communities. Madigan said these scammers operated as ?storm chasers,? soliciting vulnerable consumers door to door who never saw repairs completed.
  • Tropical Home Improvement Inc. and President Herberth Pulgarin, based in Addison, for allegedly aggressively pursuing consumers for payment after performing no work and for offering unlicensed public adjusting services.
  • Randy Oaks & Sons Asphalt Paving and Seal Coating, Randy Oaks Sr. and Randy Oaks Jr., based in Urbana, for allegedly soliciting older citizens door to door for asphalt work. After consumers paid the contractors for the work, the defendants demanded additional payments of thousands of dollars more under the threat of verbal and physical intimidation in order to complete the contracted work.

Madigan?s lawsuits ask the court to permanently ban the defendants from working in the home repair trade in Illinois, cancel any pending contracts with homeowners and obtain restitution for affected consumers. The lawsuits also seek to impose on the defendants an array of civil penalties for the allegations laid out in each of the complaints.

Madigan offered the following tips to help protect families and businesses from being duped by dishonest contractors:

  • Be wary of contractors who go door to door to offer repair services. Home repair con artists are often transients who move quickly into a troubled area. Ask for recommendations from people you know and trust and, whenever possible, use established local contractors.
  • Insurance adjusters must be licensed by the Illinois Department of Insurance, and roofers must be licensed by the Illinois Department of Financial and Professional Regulation. Ask to see required state or local permits or licenses.
  • Call the Attorney General?s Consumer Fraud Hotline to determine if consumer complaints have been filed against a particular business.
  • Even if there is a need to act quickly, shop around for the best deal. Get written estimates from multiple contractors and don?t be rushed into a deal.
  • Get all the terms of a contract in writing and obtain a copy of the signed contract. Never make full payment until all the work has been completed to your satisfaction and never pay in cash.

Madigan also reminded consumers that the Illinois Home Repair and Remodeling Act requires contractors to furnish customers with written contracts for any repair or remodeling work costing more than $1,000. A contract must be signed by both the customer and the contractor. The law also requires contractors to carry at least minimum amounts of insurance for property damage, bodily injury and improper home repair. Contractors also must provide consumers with an informational pamphlet entitled ?Home Repair: Know Your Consumer Rights.?

Madigan urged homeowners to contact her Consumer Fraud Hotline, (800) 386-5438, to report being victimized by a home repair scheme or to learn tips for finding a reputable contractor.

Assistant Attorneys General Shannon DeLaMar, Junko Minami, Janice Parker and Eric Sirota are handling the cases for Madigan?s Consumer Fraud Bureau. ?
